Booking Terms & Conditions

Please read these Booking Terms and Conditions carefully as they apply to each traveller included in bookings with Kalejo Travel.

If you or someone in your travelling party requires physical or other special assistance whilst travelling, please carefully read terms 25 and 26 prior to requesting a booking.

Definitions

“Kalejo” or “we” means Kalejo Travel Pty Ltd ABN 47 638 647 819.

“You” means a person seeking or receiving Services from Kalejo (and “Your” has a corresponding meaning)

“Services” means the travel arrangements and Services specified in Your confirmation invoice.

“Booking Conditions” means these Booking Terms and Conditions.

Our Contract

1.1             By booking a trip with Kalejo (whether personally or through an agent) You are deemed to have agreed to these Booking Conditions and Your booking will be accepted by Kalejo on this basis. Kalejo will only accept bookings from persons over 18 years of age. If Kalejo accepts Your booking we will issue a confirmation invoice. A contract will exist between Kalejo and You from the date the confirmation invoice is issued and sent by Kalejo to You. The Services to be provided are those referred to in Your booking confirmation invoice.

1.2            These Booking Conditions constitute the entire agreement between You and Kalejo and apply to each traveller included in a booking with Kalejo.

Deposit and final payment requirements

2.1            You are required to pay a non-refundable deposit of 250 Euro per person per trip for Your booking to be confirmed. If Your booking is made within 60 days of the departure date then the full amount is payable at the time of booking. Please note that different deposit amounts may be required for selected trips including custom tours. The full amount, from which the deposited amount is deducted, is required 60 days prior to departure (unless otherwise specified on the invoice). Please refer to Your booking confirmation invoice for details regarding final payments.

2.2            If Your booking is made within 60 days of tour commencement, the full amount must be paid at time of booking and all applicable cancellation penalties will apply. If a request is made within 60 days of trip departure and cannot be confirmed, payment will be refunded.

Failure to make payment

3.1            Failure to complete payment by the due date on Your invoice may result in automatic cancellation of all travel Services and Your place may be offered to our waitlist. In such circumstances, You will forfeit Your non refundable deposit.

3.2            Booking correspondence is made by email. Guests take responsibility to set email filters to accept our email address. No extensions will be given for misplaced emails filtered into junk mail folders.

Form of payment

4.1            Payments can be made via by major credit cards or debit cards (Visa, MasterCard, Maestro) using our online payment system. Please note that a fee of up to 3.75 per cent may be applied to credit card payments. You will be advised of the exact fee amount (if any) at time of payment.

4.2            For security purposes, we are required to collect the credit card billing address, card expiration date and the customer verification code every time a payment is applied. Third party credit cards are not accepted.

Prices

5.1            All prices are in Euro unless otherwise specified.

5.2            Prices are per person based upon shared twin room occupancy.

5.3            Prices do not include items of a personal nature such as, but not limited to laundry, water, beverages, food, passport and visa fees, insurance, museum entry and sightseeing unless specifically indicated in the package inclusions.

5.4            Prices are correct at time of publication and are based on costs, charges, tariffs, rates, prices, taxes, levies, exchange rates and other considerations at the time of tour release. All are subject to change.

5.5            No surcharges regarding cost or currency fluctuations will be made once the deposit is received. No refund will be made on account of reduction of any of the above.

Cancellations & refunds

6.1            Travel arrangements for any guest may be cancelled at any time by the person who made the booking. Notice of cancellation must be made in writing by email to hello@kalejotravel.com or using the online form available on the Contact Us page of the Kalejo Travel website. Cancellation terms will be applied based on the date that the written cancellation is received and based on the number of days prior to departure as outlined below:  

  • Up to 60 days prior to departure: €250pp (or the cost of the deposit – whichever is greater)   

  • 60 to 46 days prior to departure: 30% of tour cost  

  • 45 to 31 days prior to departure: 50% of cost 

  • 30 to 7 days prior to departure: 80% of cost 

  • Less than 7 days / No Show: 100% of cost

6.2           If a guest fails to join the guided holiday on the day of departure, cancellation fees will be 100%, unless the guest notifies us of the delay and joins the guided holiday later at their own expense. 


6.3           Any eligible refunds will be processed in the same method the guest used to make payment to Kalejo Travel. Kalejo Travel cannot be held responsible for any fees Your bank charge to accept this refund. Refund amounts are dependant on the bank’s currency conversion on the day. Kalejo cannot be held responsible for any gains or losses made by You in this transaction.

6.4           Cancellation fees are additional to any cancellation fees or other charges that may be levied by Your travel agent. 


6.5           If a person in a party cancels and there is a room change caused by this cancellation (such as a Twin/Double to Single, or Triple to Twin/Double), charges for the new room type will be the responsibility of the remaining party.

6.6           Illness, absence and early return expenses are the guest’s responsibility. There is no refund for absence or early departure from a trip, including but not limited to missed hotels, transfers, meals or sightseeing. Kalejo requires You to purchase travel insurance to cover such circumstances. Kalejo makes no representation or guarantees concerning reimbursement, scope of coverage, or other aspects of any travel insurance policy or claim. 


6.7           Deposit, Final Payment, and Cancellation penalties may differ for custom itineraries and will be advised at time of booking on Your invoice.

6.8 In the event of tour cancellation or postponement due to government imposed hotspots due to Covid19 or a similar event, Kalejo will offer a full travel credit of the amount paid, or a refund of the trip cost, minus your non refundable deposit.

Reservation changes

7.1            Changes to an existing reservation up to the final payment date, whatever the cause, will incur a €50 per person change fee, potential loss of any supplier fees (such as non refundable event tickets, park permits etc.) plus any costs for replacement Services.

7.2            On or after the final payment date, the €50 change fee is no longer valid and cancellation terms apply.

7.3            Replacing a travelling passenger with another travelling passenger (name changes) constitutes a cancellation, subject to cancellation penalties, and is not covered by this Reservation Changes policy.

7.4            Changes or additions after departure are subject to local rates at the time of amendment and must be paid directly by the passenger to the service provider. There are no refunds for unused Services.

Booking on behalf of others

8.1            By booking on behalf of other participants, You are deemed to be the designated contact person for every participant included on that booking. This means that You are responsible for making all payments due in connection with Your booking, notifying Kalejo or Your travel agent if any changes or cancellations are required and keeping Your party informed. 

8.2           By booking on behalf of another person or persons, You guarantee that You have obtained all required consents. You are responsible for verifying that any information You provide on behalf of another participant is complete and accurate and Kalejo will under no circumstances be liable for any errors or omissions in the information provided to complete a booking.

8.3           You guarantee that You have provided each member of Your travelling party with a copy of these terms and conditions and notified them of the application of these terms to Your trip. You guarantee that each member of Your travelling party agrees to be bound by these terms and conditions.

Tour cancellation (withdrawal of service)

9.1            Kalejo Travel reserves the right to cancel or reschedule any group tour or individual booking for any reason including insufficient demand or events beyond our control. Cancellation will be advised at least 30 days prior to the tour's departure, except in the event of ‘Force Majeure’ as per section 34.1 of these Terms and Conditions.

9.2           If a cancellation is made by Kalejo any time prior to departure of the tour, Kalejo will either refund the amount received for the guided holiday booking (except when a final payment was not made), or offer a comparable holiday if available. Kalejo will refund any difference in price if the alternative is of a lower price, however, the guest will be responsible for additional costs if the alternative is priced higher.

9.3           All refunds will be returned by the same method of payment made to Kalejo Travel. We cannot be held responsible for any fees Your bank charge to accept this refund. Refund amounts are dependant on the bank’s currency conversion on the day. Kalejo cannot be held responsible for any gains or losses made by You in this transaction.

9.4           Kalejo is not responsible for other travel arrangements affected due to our cancellations and is not liable for any cancellation penalties incurred on other travel arrangements, including but not limited to visas, vaccinations, travel insurance excess or non-refundable flights. Your personal travel insurance may cover these expenses.

9.5           Voluntary cancellations due to political instability, acts of terrorism, government intervention or government travel warning will be subject to the above fees, provided the program is deemed able to continue by Kalejo Travel.

9.6 In the event of tour cancellation or postponement due to government imposed hotspots due to Covid19 or a similar event, Kalejo will offer a full travel credit of the amount paid, or a refund of the trip cost, minus your non refundable deposit.

Itinerary, inclusions & flexibility

10.1          The price of Your trip includes the following:

  • accommodation as detailed in the trip itinerary; 

  • all transport detailed in the trip itinerary; 

  • sightseeing experiences, entrance fees and meals as set out in the trip itinerary; and  

  • the Services of a Travel Expert and English speaking Local Insiders as described in the trip itinerary.

10.2         No allowance or refund can be made for meals, accommodation, excursions, etc. that You elect not to take, or when museums, shops, etc. are closed.

10.3         If You have made Your own arrangements to arrive to a destination before Your guided holiday, or stay on after, Your stay will be at Your sole expense, as is any transfer to either the hotel or airport.

10.4         Kalejo strives to improve guided holiday itineraries, Services and features. If improvements can be made, or if circumstances beyond our control make changes necessary, we reserve the right to vary itineraries and to substitute hotels.

10.5         Times listed in itineraries are approximate and meant only as guidelines. Some itineraries may have early morning start times for sightseeing in order to complete the touring during daylight hours or avoid afternoon heat. It is Your responsibility to arrive on time for all scheduled package components. Arriving late may be considered a ‘no show’, in which case You will not be eligible for refund for the unused SERVICE(s).

10.6         Kalejo itineraries may contain suggestions for activities for Your leisure time; these suggestions do not constitute an endorsement of any specific service provider and the decision to participate in any such activities should be made independently and with due consideration.

10.7          Religious holidays, national celebrations, renovations, and unforeseen circumstances, including but not limited to weather conditions may result in some monuments and sites being closed. On these occasions, touring itineraries may be amended to reflect these closures. Therefore, we reserve the right to adjust the sequence and/or substitute any hotels with others of similar category. In such cases there will be no cost adjustment.

10.8         National monuments and tourist sites regularly undergo renovations, which can obscure the monument's view. No tour will be cancelled due to renovations, however Kalejo Travel will decide based on the conditions whether to amend an itinerary.

10.9         If You feel Your enjoyment might be diminished by any of the circumstances above, please check with the respective national tourist office before selecting a specific departure date.

10.10       Security is a major concern to Kalejo Travel and the situation globally is constantly changing. Events around the world, coupled with the travel advice put out by various governments, may at times necessitate changes to the accommodations and itinerary or even trip cancellation. You must accept these risks involved in travel to any country that may experience security difficulties and accept responsibility for Your own travel decisions.

Included meals

11.1           Beverages other than drinking water are not typically included with meals, unless specifically stated.

11.2          Dietary request and preferences must be provided at the time of booking or submitted in writing at least 72 hours prior to departure to hello@kalejotravel.com. Any meal requirements, including allergies, are received on a request basis only. Kalejo Travel cannot assure special meal requests will be fulfilled and does not assume responsibility or liability if requests are not fulfilled.

Hotel accommodation

12.1          Hotel accommodation prices are per person based on two persons sharing with private bath or shower. The number of persons accommodated does not dictate the room size and in general, European hotel rooms will be significantly smaller than those in North America and Australia.

12.2          All hotel rates are based on Kalejo’s agreements with its suppliers and are not negotiable.

12.3          We reserve the right to make substitutions with hotels of equal standard. There will be no refunds for any difference in the cost of those accommodations.

12.4          Triple rooms may be available by request on selected trips in limited numbers. Triple rooms will often feature one foldaway bed plus one double bed. Three adults may find these rooms small and suitcase space restricted. They are generally more suitable for two adults and one child.

12.5          Every effort has been made to reserve two bed rooms; however, on some occasions, rooms with one double bed may be the only choice available. Other rooms may feature a single bed and rollaway bed, murphy bed or sleeper sofa.

12.6         In special circumstances, and by request, Kalejo may operate a room sharing service – matching two guests of the same sex to share a room. Kalejo Travel shall not be responsible or liable for any claims or issues arising out of shared rooming, such as disputes between roommates. 

12.7          Room selection in all cases, unless otherwise reserved, is strictly at the discretion of the hotel’s management on a run of house basis. Special requests such as bed types, smoking preference and connecting rooms must be made at time of booking, are subject to availability and cannot be guaranteed.

12.8         Although available at most 4 and 5 star hotels, air conditioning varies greatly. Many European hotels were built before central air conditioning was introduced. Air conditioning is often shut down at night and from the end until the start of the summer months.

12.9         Many hotels are 100% smoke free, including all guest rooms, restaurants, lounges, meeting rooms and public spaces. Smoking in a non smoking room may result in a fine.

12.10        Hotel room sizes, standards, facilities and Services provided may vary from country to country and region to region and are often local in style.

12.11         Hotel check in time is generally not before 4pm and check out time is prior to noon. Please make adequate considerations for this when a late night / early morning flight is being used at the beginning or end of trip.

12.12        Hotel Frequent Traveller program points are not earned with hotels on Kalejo holidays.

12.13        You are responsible for any costs incurred as a result of damage or excess cleaning fees related to Your accommodation. You are advised to immediately report any pre existing damage in Your room to hotel and/or Your Kalejo Travel Expert as soon as it is discovered.

Travel Expert & their authority

13.1          Guided holidays are conducted in English by a professional Travel Expert and Local Insiders (as per the itinerary). All commentary and instructions will be provided in English only. For maximum enjoyment and understanding, You must be able to understand, read and speak English.

13.2          The decision of the Travel Expert is final on all matters likely to affect the safety or well-being of any traveller or staff member participating in the trip. If You fail to comply with a decision made by a Travel Expert, or interfere with the well-being or mobility of the group, the Travel Expert may direct You to leave the trip immediately, with no right of refund.  Kalejo may also elect not to carry You on any future trips booked.

Coach & seat rotation

14.1           To provide all guests with the opportunity to experience all viewpoints on the coach, Kalejo Travel operates a daily coach seat rotation with no exception. Seat assignments are dictated by the Travel Expert. Single passengers may be seated next to another traveller.

14.2          Coaches that are equipped with a toilet facility are strictly intended for emergency use only. Regular comfort stops are made on travelling days.

14.3          For Your comfort, Kalejo enforces a strict no smoking (including e-cigarettes) and no alcohol policy on board our coaches.

Transfers

15.1          Complimentary airport transfers are offered on the first and last day of trip only. No refunds or compensation will be offered to guests that choose to arrive to the starting city earlier/later than the tour start/end date, or for unused or missed transfers due to flight delays or any other reason.

15.2          Transfers operate at set times outlined in Your tour itinerary and cannot be changed or delayed.

15.3          Guests are required to provide their arrival and departure flight information to Kalejo Travel at the time of booking. It is Your responsibility to update us with any changes.

15.4          Should guests make their own arrangements, eg. taxi or private transfer, this is at their own expense and will not be reimbursed by Kalejo under any circumstance.

Luggage 

16.1          Group tour costs include the cost of one piece of luggage per person, which will be portered and stowed under the coach on travel days. One small carry on bag is also permitted. This must fit in the overhead luggage compartment on board the coach or underneath the seat in front of You. There may not be additional space in the underneath luggage compartment, therefore small carry on bags with wheels should be avoided, as they do not fit in overhead compartments.

16.2         Carry on/hand luggage is the responsibility of each guest and must be taken on and off the coach by the guest each day.

16.3      A request must be sent in writing(email hello@Kalejotravel.com) for any additional baggage and may not be permitted due to group size and space constraints on the coach. If approved, handling fees may apply.

16.4          Luggage must be no heavier than 23kg / 50lbs

16.5         Kalejo Travel will not be responsible for loss or damage to luggage and personal belongings. You must report any loss or damage immediately at the time of the incident to Your Travel Expert who will assist with a written report that can be used for an insurance claim.

16.6         Kalejo and its Travel Experts cannot assist in locating lost items after the guest disembarks or completes their holiday.

Wifi

17.1           Complimentary WiFi is available in many hotel guestrooms and/or the public areas.

17.2          Complimentary WiFi is also provided on board our main touring coach in European Union countries. This service roams, just like Your mobile/cell phone, and as a result the connection will be slower than standard broadband and at times may not be available. The coach wifi service is useful for sending text messages and emails, but cannot be used for audio and video streaming. Daily usage limits may apply.

Tipping

18.1          Tips/gratuities included in the trip price cover Services provided by dining room waiters (where a meal is included or takes place during an Optional Extra), housekeeping staff and porters at hotels.

18.2         Should You wish to extend a gratuity to Your coach driver, Local Insider or Travel Expert, You may do so on a voluntary, individual basis at the end of Your holiday. Complete tipping guidelines are provided with final travel documents.

Exclusions

19.1          Any items and matters not referred to above, including, airfares to and from Your destination; passport and visa fees; insurances of all kinds; tips/gratuities to Travel Experts, Local Insiders, and coach drivers; laundry; phone calls; minibar; beverages and meals not detailed in the itinerary; Optional Extras; and all items of a personal nature. Additional taxes and surcharges may be collected by foreign governmental and non governmental entities. The price does not cover costs and expenses, including Your return home, if You leave the guided holiday by Your own choice, or by our decision based on behaviour that disrupts the trip, due to illness, action by any government or other reason. This list is illustrative and not a complete list of every item not included.

Optional Extras

20.1         A selection of optional sightseeing tours will be available for purchase once the tour commences and will be presented by the Travel Expert based on availability. A detailed list and cost of these will also be included in Your travel documentation.

20.2         You can book and pay for Optional Extras through Your Travel Expert by cash or credit card.

20.3         Many Optional Extras are operated by independent third party suppliers, not Kalejo Travel. These are not part of the holiday package provided by us. Your contract will be with the operator of the extra activity. We are not responsible for providing the extra, or anything that happens during the experience. Some extras involve outdoor activities and/or can be physically demanding. You must make Your own decisions about extras and participate only in activities that suit Your physical ability. We suggest that You speak with Your medical provider if You have questions about Your abilities. We recommend You check whether any insurance You have also includes Your participation in adventure activities You may undertake.

20.4         Some Optional Extras are weather dependent or require a minimum number of participants. Extras may be cancelled by operators or the Travel Expert at any time. In such cases, You will receive a full refund for that experience.

Travel Insurance

21.1          Travel insurance is mandatory for all our travellers and should be taken out at the time of booking. Your travel insurance must provide cover against personal accident, death, medical expenses and emergency repatriation. We also strongly recommend it covers Covid19, cancellation, curtailment, personal liability and loss of luggage and personal effects. You must provide Your travel insurance policy number and the insurance company's 24 hour emergency contact number prior to Your trip commencement. You will not be able to join the trip without these details. If You have travel insurance connected to Your credit card or bank account please ensure You have details of the participating insurer, the insurance policy number and emergency contact number with You rather than the bank's name and credit card details.

Passports, visas & country requirements

22.1          All guests, including children, must have a machine readable passport valid for six months after their trip return date, along with applicable visas. Some countries require a full blank page in the passport for stamping purposes.

22.2         All guests are responsible for ensuring that they have the correct visas, permits and certificates for the trip. All visas, reciprocity fees, affidavits etc. are at the guest’s own cost. Obtaining and carrying these documents is the sole responsibility of the guest. Kalejo is not responsible if You are refused entry to a country because You lack the correct passport, visa or other travel documentation, or for any delays, damages, and/or losses including missed portions of their holiday related to improper documentation or government decisions about entry.

Conduct of trip participants

23.1          When making a booking, You accept responsibility for the proper conduct of all members of Your party.

23.2         You must at all times comply with the laws, customs, foreign exchange and drug regulations of all countries visited, and You also agree to travel in accordance with our responsible travel guidelines. 

23.3         Kalejo Travel reserves the right to reject or expel any individual who is deemed disruptive or incompatible with the interests of the group, including, but not limited to if it is reasonably believed that an individual is:

a.     dangerous to others or to themselves;

b.     has engaged in or is threatening to engage in behaviour that may adversely affect the safety, security, wellbeing or enjoyment of other individuals;

c.      intoxicated and/or under the influence of drugs

d.     found to be carrying weapons of any type, including but not limited to, firearms, knives, mace, brass knuckles;

e.      has failed or refused to follow Kalejo’s rules and procedures or the instruction of Kalejo’s employees or representatives;

f.      deemed to have acted in a threatening or abusive manner (physical or verbal) to Kalejo staff.

23.4         If You are rejected or expelled, full cancellation charges will apply and no refund will be made. We shall have no obligation to pay compensation or meet any costs or expenses (including but not limited to alternative accommodation and return transportation arrangements) guest may incur as a result of the travel arrangements being terminated.

23.5         Kalejo Travel shall be entitled to recover from the individual any cost or expenses incurred by Kalejo or its representative in the removal of the individual.

23.6         You agree to indemnify us against all third-party claims, actions, damages and remedies which may be brought against us in respect of Your participation in the trip.

Children

24.1          All children under 18 must be accompanied by an adult who is responsible for the safety of their children, including to provide any necessary safety equipment. Minimum age for children on group tours is Kalejo Tours is six (6) years old. There is no minimum age on custom packages.

24.2         Many countries have adopted practices to prevent international abductions of children. If a person under the age of 18 years will be travelling with an adult other than his/her parents, or with only one parent, a notarized letter written by the parents, or non travelling parent, granting authorisation to travel, including the dates of travel should be carried.

Health requirements

25.1          Check with Your healthcare provider for up to date requirements for all countries on Your itinerary. You may also check the World Health Organization (http://www.who.int/en/).

25.2         Required inoculations, if any, must be recorded by Your health practitioner on a valid vaccination certificate which You must carry for proof of inoculation where required.

25.3         Individuals with heart disease, chronic illness, physical handicap, advanced pregnancy, or mental illness should not participate in rigorous travel programs. Any person who arrives to the destination ill with apparent fever or becomes ill during the tour, will be directed to a local medical facility for diagnosis. Only upon written clearance by an accredited medical facility indicating that You are able to participate in the remaining activities of the tour, will You be allowed to resume group travel. All costs associated with medical treatment and related expenses, such as additional hotel nights or transportation not included in the original itinerary, will be the responsibility of the passenger.

25.4         In the event of Your withdrawal from a tour after the commencement as a result of illness, we can assist You with finding a medical practitioner to obtain a medical certificate in support of any travel insurance claim You may want to process. No refunds will be made from Kalejo Travel for any absence from the trip.

Physical assistance and travellers needing special assistance

26.1         In purchasing Your holiday, You attest that You are physically fit for it. If You have concerns, please request additional details about Your journey from Kalejo or Your travel agent.

26.2         Kalejo Travel welcomes guests with special needs, however please note that tour participants requiring any form of assistance, including travellers with physical disabilities, sight, hearing or mobility impairments are required to notify Kalejo prior to booking a tour (or as soon as possible if the special assistance need arises after the booking is made). Kalejo will review the tour requirements with You to determine the level of assistance You may need and to ensure that the trip You have selected is suitable for You.

26.3         Many trips include rough terrain, extensive walking over cobblestone streets, uneven pavement, steps and/or locations which may not be easily accessible or accessible by wheelchair.

26.4         Any participant requiring assistance (eating, toileting, dressing, or with mobility for example) must be accompanied by a companion who is capable of and fully responsible for providing the assistance. Kalejo Travel Experts, guides, drivers or other tour, hotel or transfer personnel are not able to provide individual Services such as assisting with walking, pushing a wheelchair or helping with getting off and on motor coaches and other vehicles.

26.5         Hotels, transportation providers, restaurants and excursion venues may not have ramps, wide entryways or elevators/lifts to accommodate disabled passengers or devices such as wheelchairs, walkers and motorised scooters. These parties are independent entities which Kalejo does not control. Kalejo cannot guarantee disability access or accommodations for guests travelling on international guided holidays.

26.6         Due to physical constraints and space limitations, wheelchairs and walking frames cannot be taken aboard motor coaches, or other forms of transportation.

26.7   Service animals and motorised scooters cannot be accommodated on group tours.

26.8         Kalejo does not provide personal devices (such as wheelchairs, hearing
aids or prescription eye glasses).

26.9         Kalejo reserves the right to reject participation or remove any individual from a tour or activity in the event that notification was not provided and/or when, in our sole judgment, continued participation would hinder the Services to be provided to all guests. Expenses, including cancellation fees and/or costs for alternate travel plans or to return home, will be the responsibility of the passenger. No refunds will be provided if a decision is made to exclude an individual from a tour or activity.

Medical assistance

27.1          Kalejo does not employ medical personnel. Any necessary medical attention must be sought at a local facility, if available, at Your expense. Kalejo Travel is not responsible or liable for losses or costs incurred due to unavailability of medical Services, or medical Services obtained while on tour, or for the quality of the care or Services received. Medical care in other countries is not always comparable to care that You may receive in Your local area. You are required to purchase medical insurance that will cover You while on holiday. Your regular health insurance benefits may not apply abroad.

Acceptance of risk

28.1         By traveling with Kalejo Travel, You acknowledge that You have considered any potential risks to health and safety. You assume responsibility for all such risks and release Kalejo from all claims and causes of action arising from any losses, damages or injuries or death resulting from risks inherent in travel, visiting foreign destinations, and participating in activities such as those included in the tour itinerary or otherwise offered by Kalejo Travel.

28.2  For the avoidance of doubt, each traveller must sign an individual Passenger Agreement (with the exception of minors). The Agreement will be sent to You along with Your confirmation invoice.

28.3        Travel documents will not be released without a completed Passenger Agreement and failure to provide the agreement may be seen as an incomplete booking. Kalejo reserves the right to cancel bookings without a completed Passenger Agreement and the cancellation policy will apply.

28.4        You agree to take all prudent measures in relation to Your own safety while on Tour including, but not limited to, the proper use of safety devices (including seatbelts) and obeying all posted signs and oral or written warnings regarding health and safety. Neither Kalejo nor its Third Party Suppliers are liable for loss or damages caused by Your failure to comply with safety instructions or warnings.

Travel safety advice 

29.1         At Kalejo, we take your safety and security very seriously. We have a strong network of Travel Experts, ground operators and colleagues which help us stay informed in all the destinations that we operate. We closely monitor local situations, which enable us to make the operational decisions necessary to keep our tours running safely. Millions of people travel the world each year and experience enjoyable and safe trips, but crimes against people and property are sadly a fact of life. It is very important to be aware of your surroundings and avoid drawing attention to yourself. Please remember that you have the same responsibility for your personal safety and possessions as you do at home. It is essential to prepare for a safe and healthy travel abroad. Therefore before you travel, we strongly recommend that you visit your government’s travel advisory website for up to date travel advice on the countries that you are visiting. These websites generally provide useful information on subjects such as safety and security information, health precautions and medications, health insurance and additional tips for traveling abroad. We recommend that you review the safety guidance that may be provided by us, our agents or suppliers, either before you go or when you arrive in your destination. You can also find helpful tips on our website in the ‘Know Before you Go’ page on our website. We do know that inspite of careful planning, things can sometimes still go wrong, so rest assured, we will be there to help and support you.

Breach of these terms

30.1         Each guest is required to comply with the terms, conditions, requirements, laws, rules and/or regulations of any service provider, or any country or governmental authority, and shall be liable for any such non-compliance.

30.2        Kalejo Travel may decline booking any guest or remove any guest who cannot comply or refuses to comply with these terms and conditions. If this occurs, the guest is responsible for the cost of their return travel expenses. Kalejo Travel shall not be liable for any losses and no refund shall be provided.

Complaints

31.1          If You have a problem during Your holiday, please inform Your Kalejo Travel representative immediately, who will try to make things right. If the matter is not resolved locally, please submit Your issue in writing via email to hello@kalejotravel.com within sixty (60) days of the end of Your holiday.

31.2         Claims for refund of undelivered Services must be accompanied by payment receipt(s) and local documentation.

31.3         Complaints regarding a hotel’s standards or amenities should be addressed directly with the hotel’s management. Refunds are not normally considered by hotels if they were not given an opportunity to address those complaints locally.

31.4         Processing of successful claims will take up to eight weeks from the date Kalejo Travel receives relevant documents. Refunds will be processed in the same way payment was originally made to Kalejo Travel, up to the total amount paid.

31.5         These terms may not be changed by anyone other than an authorised representative of Kalejo Travel and must be documented in writing. Kalejo Travel is not obliged to guarantee promises (written or verbal) made by local hotel staff, tour guides, or any other persons not under direct employment of Kalejo Travel.

Privacy

32.1         In order to fulfil Your service request and process Your holiday booking, Kalejo may share Your personal and/or sensitive information with third parties including but not limited to the following: 

  •  suppliers of Your travel arrangements;   

  • public authorities (such as customs and immigration);  

  •  security and credit checking organisations;

  • contractors who provide Services to or for us (e.g. sending mail, providing marketing assistance, etc)  

  • and otherwise as required by law.

32.2        In making this booking, You consent to this information being passed on to the relevant persons. Where the data might be passed on for marketing purposes, You have the right to opt out of future marketing.

Limitation of liability

33.1          Kalejo Travel contract with a network of companies, government agencies and individuals to assist in the running of our trips. Kalejo is not responsible for the acts and omissions of these third parties.

33.2         To the fullest extent permitted by law:

a.     any liability for any loss, death, injury or damage which You may suffer (directly or indirectly) in connection with or arising out of Your participation in a trip, or any breach of the Booking Conditions, is excluded;

b.     You release us and our officers, employees, agents and representatives from any liability and expressly waive any claims You may have against us arising out of or in connection with Your participation in a trip; and

c.      any condition or warranty which would otherwise be implied by law into these Booking Conditions (Implied Warranty), is excluded.

33.3         To the extent an Implied Warranty cannot be excluded, our liability in respect of the Implied Warranty is limited to (in our absolute discretion): (i) the provision of a similar trip to an equivalent value; or (ii) a refund of the total amount received by us from You in connection with Your booking.

33.4         Any claim by You is excluded to the extent that it is for indirect or consequential loss, loss of profits or economic loss, however it arises, or for indirect, special, punitive or exemplary damages.

Force Majeure

34.1          Kalejo will not be liable in any way for death, bodily injury, illness, damage, delay or other loss or detriment to person or property, or financial costs both direct and indirect incurred, or for Kalejo Travel’s failure to commence, perform or complete any duty owed to You if such death, delay, bodily injury (including emotional distress or injury), illness, damage or other loss or detriment to person or property is caused by Act of God, war or war like operations, mechanical breakdowns, pandemic, epidemic, endemic, terrorist activities or threat thereof, civil commotions, labor difficulties, interference by authorities, political disturbance, howsoever and where so ever any of the same may arise or be caused, riot, insurrection and government restraint, fire, extreme weather or any other cause whatsoever beyond the reasonable control of Kalejo; or an event which the Kalejo or the Third Party Supplier of Services, even with all due care, could not foresee any and all of which, individually and collectively, constitute “Force Majeure”.

Severability

35.1          In the event that any term or condition contained in these Booking Terms and Conditions is unenforceable or void by operation of law or as being against public policy or for any other reason then such term or condition shall be deemed to be severed from this contract or amended accordingly only to such extent necessary to allow all remaining terms and conditions to survive and continue as binding.   

Amendments for custom tours

36.1        For custom tours, amendments to these terms (if any) will be explicitly notified in a Custom Group Proposal and/or Custom Group Confirmation.

Applicable law

37.1          The laws of Victoria, Australia govern these Booking Conditions to the fullest extent allowable.  Any disputes in connection with a trip or these Booking Conditions must be initiated in the courts of Victoria, Australia.
